TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, OPERATORS, CONTRIBUTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY LINKED THIRD-PARTY SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US TO USE THE SITE IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. BECAUSE THE SITE IS FREE TO USE, THIS AMOUNT WILL USUALLY BE US $100.

You agree to defend, indemnify, and hold us harmless from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law rules. Except where prohibited, you agree that any dispute arising out of or relating to these Terms or the Site will be brought in the state or federal courts located in Johnson County, Kansas, and you consent to their jurisdiction.

Before filing a claim, you agree to contact us at hello@overlandpark-ks.com and try in good faith to resolve the issue informally.

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign ours as part of a reorganization or sale of assets.
